The Price of Neglect: A Life and a Hefty Fine
The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) has cited Sound Construction Inc. for willful disregard of worker safety, resulting in a potential $1.2 million penalty. This comes after a previous workplace death and years of safety warnings.
But here's where it gets controversial: despite OSHA's previous interventions, Sound Construction continued to expose workers to dangerous excavation hazards. In 2016, the company was cited for trench safety violations, yet in December 2023, a tragic trench collapse claimed an employee's life in New Canaan.
OSHA's investigation revealed a disturbing pattern. Sound Construction failed to educate employees about trenching hazards and provided no protection for a 12-foot-deep trench. Catherine Brescia, OSHA Area Director, emphasized, "Sound Construction ignored trench safety protections, and that decision had devastating consequences."
The investigation also found the company at fault for not maintaining a safe distance between the excavator and the trench's edge and for failing to verify underground utility locations. As a result, OSHA proposed penalties totaling $394,083.
As part of a settlement agreement, the company agreed to submit active worksite lists and allow random OSHA inspections. However, during a follow-up inspection in Stamford in June, OSHA uncovered more violations, including failure to train workers on excavation hazards and inadequate protection from cave-ins.
The latest violations carry a proposed penalty of $1,224,798, more than triple the amount from the fatal incident investigation.
